Terms & Conditions
The rules for using this website. Services are provided only under a separate written agreement.
Effective date: October 21, 2026
These Terms & Conditions (“Terms”) govern your use of this website, which is operated by Upfront Security Associates, LLC (“Upfront,” “we,” “us” or “our”). Please read them carefully. Section 13 contains important limits on how disputes are resolved, including a waiver of jury trials and class actions.
1. Agreement to these terms
By accessing or using this website, or by submitting any form on it, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website. You must be at least 18 years old, or the age of majority where you live, to submit information through this website.
2. Not for emergencies
This website and its contact form are not monitored around the clock and must never be used to report an emergency or an immediate threat. If you or anyone else is in danger, call 911 or your local law enforcement immediately. Submitting a form or sending a message does not create any duty for Upfront to respond within a particular time or to take any protective action.
3. Website information only
The content on this website, including service descriptions, training information, safety tips and team biographies, is provided for general information only. It is not legal, safety, security, medical or other professional advice, and it does not replace a professional assessment of your specific situation. Descriptions of our services are general. Actual services, scope, staffing, schedules and pricing are set only in a written agreement. We may change, update or remove any content, or the website itself, at any time without notice, and we do not promise that the content is complete, current or error-free.
4. No client relationship
Using this website, submitting a form, or calling or emailing us does not create a client, contractual, fiduciary or confidential relationship, and it does not obligate Upfront to provide any service. A client relationship begins only when both you and Upfront sign a written service agreement, and that agreement, not these Terms, governs the services. We may decline any inquiry or engagement for any lawful reason.
5. Information you submit
When you submit information through this website, you confirm that it is accurate, that it is yours to share or that you are authorized to share it, and that you are not using another person’s identity. You agree that Upfront may contact you by phone, email or text message at the contact details you provide about your inquiry. Message and data rates may apply. You can ask us to stop at any time. Our use of your information is described in our Privacy Policy.
If you send us suggestions, feedback or a testimonial, you give Upfront a free, permanent, worldwide license to use, edit and publish it, along with the name and title you provide with it, on our website and marketing materials, without compensation.
6. Testimonials
Testimonials on this website reflect the individual experiences and opinions of the people who gave them. Every situation is different, so they are not a guarantee, promise or prediction of the results you will experience.
7. Acceptable use
You agree not to:
- use the website for any unlawful, fraudulent or harmful purpose;
- submit false or misleading information, or impersonate any person or organization;
- send spam, threats, harassment or abusive content through the website;
- try to gain unauthorized access to the website, its staff area or its systems, or interfere with their operation, security or availability;
- upload or transmit viruses, malware or other harmful code; or
- copy, scrape or harvest content or information from the website by automated means without our written permission.
We may block access to the website for anyone who violates these Terms, and we may report unlawful activity to the authorities.
8. Intellectual property
This website and its content, including text, graphics, logos, photographs, design and code, are owned by or licensed to Upfront and are protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. Any other copying, modification, distribution or use requires our prior written permission. “Upfront Security Associates” and our logo are our trademarks.
9. Third-party websites
This website may link to websites operated by others, such as the Better Business Bureau, Facebook and Google Maps. We do not control and are not responsible for their content, policies or practices, and a link does not mean we endorse them. You use them at your own risk.
10. Disclaimer of warranties
THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR AVAILABILITY. UPFRONT DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY MESSAGE OR FORM SUBMISSION WILL BE RECEIVED. NO SECURITY MEASURE, SERVICE OR TRAINING CAN ELIMINATE ALL RISK, AND NOTHING ON THIS WEBSITE IS A GUARANTEE OF SAFETY OR OF ANY PARTICULAR OUTCOME.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UPFRONT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE WEBSITE, ITS CONTENT OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UPFRONT’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you. These limits do not apply to services provided under a signed service agreement, which are governed by that agreement.
12. Indemnification
You agree to defend, indemnify and hold harmless Upfront and its owners, officers, employees, contractors and agents from any claims, losses, damages, liabilities and expenses, including reasonable attorneys’ fees, arising out of your misuse of the website, your violation of these Terms or the law, or information you submit.
13. Disputes, governing law and venue
- Talk to us first. Before filing any claim, you agree to send a written description of the dispute to us at the address below and to try in good faith to resolve it informally for at least 30 days.
- Governing law. These Terms and any dispute relating to the website are governed by the laws of the State of New York, without regard to its conflict-of-law rules.
- Venue. Any lawsuit must be brought only in the state courts located in Suffolk County, New York, or the United States District Court for the Eastern District of New York, and you consent to the jurisdiction of those courts. Either party may bring an eligible individual claim in small claims court.
- Time limit. To the extent permitted by law, any claim relating to the website or these Terms must be filed within one (1) year after it arises, or it is permanently barred.
- No class actions. To the extent permitted by law, claims may be brought only in your individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding.
- JURY TRIAL WAIVER. TO THE EXTENT PERMITTED BY LAW, YOU AND UPFRONT EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION RELATING TO THE WEBSITE OR THESE TERMS.
14. General terms
- Changes. We may update these Terms at any time by posting a new version on this page with a new effective date. Your continued use of the website after that date means you accept the updated Terms.
- Severability. If any part of these Terms is found unenforceable, it will be limited to the minimum extent necessary, and the rest will remain in full effect.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Upfront about the website. A signed service agreement controls over these Terms for the services it covers.
- Assignment. You may not transfer your rights under these Terms. We may assign ours, for example as part of a business transfer.
- Accessibility. We work to make this website usable by everyone. See our Accessibility Statement.
